Acceptance of Terms

Your access to or use of any BeaconMarte Store service constitutes your agreement to comply with these Terms of Service together with every federal, state, and local statute and regulation that applies to you. Should you reject any portion of these Terms, you may not use any offering provided by BeaconMarte Store. When an individual accesses our services for a company or other organization, that individual confirms they hold the authority to commit that entity to these Terms.

Use of the Website

You agree to use BeaconMarte Store's services solely for lawful, personal, non-commercial purposes unless BeaconMarte Store has granted you written authorization to do otherwise. You must not:

• Breach any governing statute or regulation, including consumer protection and product safety requirements
• Send unsolicited advertising, promotional materials, or spam through our platform
• Seek unauthorized entry to our systems, customer accounts, or inventory databases
• Misrepresent yourself as any person or entity, including BeaconMarte Store personnel or fellow customers
• Deploy automated tools, scrapers, or bots to harvest product pricing, inventory data, or user information from our platform
• Submit fraudulent, excessive, or malicious orders, including orders placed without any intention of receiving the goods
• Resell BeaconMarte Store products for commercial profit without our explicit written consent

Product Information and Pricing

BeaconMarte Store works diligently to keep product descriptions, pricing, specifications, and availability details accurate and current. Should an error affect product information, pricing, or availability, BeaconMarte Store may correct that error and cancel any orders placed on the basis of the incorrect information, at no cost to you. For goods with natural variability (such as handmade items or products made from natural materials), minor differences in dimensions, weight, or appearance compared with the listed specifications may occur. Product details and warnings are supplied for reference purposes only; BeaconMarte Store cannot guarantee that products remain free of cross-contamination during processing or packaging. Product availability may differ depending on your delivery zone, pickup location, and chosen time slot.

Orders and Payment

Every order depends on product availability and acceptance by BeaconMarte Store. BeaconMarte Store may decline or cancel any order at its sole discretion, including orders that appear fraudulent, breach these Terms, or cannot be fulfilled because of stock shortages. Full payment is required before an order is dispatched or collected, unless BeaconMarte Store agrees otherwise in writing. Minimum order values and delivery fees may apply depending on your selected delivery zone and time slot. For age-restricted products (including alcohol, tobacco, and vaping products where legally permitted), you must meet the legal age requirement for purchasing such items in your jurisdiction, and a valid government-issued ID will be required at delivery or pickup. If an item in your order is out of stock, BeaconMarte Store will notify you before dispatch and may offer a suitable substitute or refund the unavailable item, unless you have opted out of substitutions at checkout.

Intellectual Property

All content on BeaconMarte Store's platforms — including text, images, logos, software, private label product packaging, and the "BeaconMarte Store" name and branding — belongs exclusively to BeaconMarte Store and is safeguarded by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any BeaconMarte Store content without our explicit written consent. User-generated content (including product reviews, photos, and comments) submitted to our platforms may be used by BeaconMarte Store for marketing, promotional, or operational purposes, in accordance with our Privacy Policy.

User Responsibilities

You are responsible for keeping your account credentials confidential and for all activities conducted under your account. You must notify BeaconMarte Store immediately of any unauthorized use of your account or any other security breach. You are also responsible for providing accurate, up-to-date contact, delivery, and payment information when placing orders, and for ensuring that any special instructions, eligibility requirements, or product-specific conditions you submit are truthful and complete. If you place an order on behalf of a third party, you alone are responsible for ensuring that third party meets all legal eligibility requirements for purchased products, including age restrictions for restricted goods.

Limitation of Liability

To the fullest extent permitted by law, BeaconMarte Store shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, products, or services, including but not limited to damages for incidental loss or delivery delays. Our total aggregate liability to you for any claim arising from a single transaction shall not exceed the total amount you paid for the products or services in question. BeaconMarte Store is not liable for failures or delays in service resulting from circumstances outside our reasonable control, including but not limited to supply chain disruptions, severe weather, public health emergencies, or third-party carrier delays.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of BeaconMarte Store's services shall first be submitted to BeaconMarte Store's customer support team for informal resolution. If the dispute cannot be resolved informally within 30 days, it shall be resolved through binding arbitration administered by a recognized arbitration provider in New York, NY, in accordance with the provider's commercial arbitration rules. The award of the arbitrator shall be final and binding on the parties, and may be entered in any court of competent jurisdiction.

Changes to These Terms

BeaconMarte Store may update, modify, or replace any portion of these Terms at any time at its sole discretion. Should BeaconMarte Store make material changes to these Terms, it will provide at least 30 days' advance notice via email to the address associated with your account, or via a prominent notice on our website. Your continued use of our services after the effective date of any revised Terms constitutes acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using BeaconMarte Store's services prior to the effective date of the changes.
